Article 1 - Definitions
- 4fly: flying club management platform
- User: any person using the platform
- Club: aeronautical structure using the services
- Services: all functionalities offered by the platform
Article 2 - Purpose
4fly offers a complete solution for managing flying clubs, including reservations, maintenance, training and billing.
Article 3 - Access Conditions
4fly is free to run your club (members, aircraft, scheduling, bookings, flights, pilot accounts, documents and news).
Commission fees apply only to flows collected online through the activation of payments (Stripe Connect): pilot account payments, discovery flights, gift cards, marketplace, public sales and paid events.
4fly commission: from 3% of the amount collected, decreasing with volume, Stripe fees included. Preferential terms (2.5%) may apply to clubs affiliated with a partner federation (FFPLUM, FFA).
Public sales (discovery flights, gift cards) may be collected by 4fly and then paid out to the club once its payment account is activated. Internal member payments require the activation of the club's Stripe account so that funds are paid directly to the club.
Optional subscription plans may remain available for certain clubs; they are not required to run the club.
Article 4 - Obligations
4fly commits to:
- Ensure platform availability and maintenance
- Secure user data
- Provide technical support
The user commits to:
- Provide accurate information
- Respect the terms of use
- Not misuse the platform
Article 5 - Personal Data
4fly collects and processes personal data in compliance with GDPR. Users have the right to access, rectify and delete their data.
Article 6 - Intellectual Property
All elements of the 4fly platform (logo, texts, images, etc.) are protected by intellectual property law. Any reproduction is prohibited without prior authorization.
Article 7 - Liability
4fly cannot be held responsible for indirect damages resulting from the use of the platform. Liability is limited to the amount of services paid by the user.
Article 8 - Termination
Each party may terminate the use of services under the conditions provided. In case of serious breach, termination may be immediate.
Article 9 - Applicable Law
These Terms of Service are subject to French law. Any dispute falls under the exclusive jurisdiction of French courts.
